These Terms govern your access to and use of the Prescriptr website, mobile services and telemedicine platform.

1. Introduction
Welcome to Prescriptr (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Prescriptr website, mobile services, and telemedicine platform (the “Service”).
Prescriptr is an online healthcare facilitation service that connects eligible patients with independent, registered healthcare professionals for remote medical consultations, assessment, and where clinically appropriate, prescribing services.
By accessing or using our Service, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree with these Terms, you must not use the Service.
2. Nature of the Service
Prescriptr operates as a telemedicine platform enabling remote medical consultations.
The Service may include:
- Online medical questionnaires
- Digital consultations (asynchronous or synchronous)
- Clinical review by registered medical practitioners
- Issuance of private prescriptions (where clinically appropriate)
- Referral advice or onward care recommendations
All clinical decisions, including prescribing decisions, are made solely by independent registered medical professionals.
Prescriptr does not itself provide medical diagnosis or treatment and does not replace in-person healthcare where required.
3. Regulatory Compliance
All healthcare professionals providing services through Prescriptr are:
- Registered with the Irish Medical Council (IMC) or an equivalent competent regulatory authority within the EEA/UK (as applicable)
- Bound by applicable professional codes of conduct, including the Guide to Professional Conduct and Ethics for Registered Medical Practitioners (IMC)
We operate in compliance with:
- Irish healthcare regulation
- EU Cross-Border Healthcare Directive (2011/24/EU)
- GDPR (Regulation (EU) 2016/679)
- Applicable eHealth and telemedicine guidance within the EEA
4. Eligibility
You may only use the Service if:
- You are 18 years or older
- You are legally capable of entering into binding contracts
- You are located in a jurisdiction we currently support within the European Economic Area (EEA) or other explicitly listed countries
- You provide accurate and complete medical information
The Service must not be used in emergencies. If you are experiencing a medical emergency, you must contact local emergency services immediately.
5. Telemedicine Limitations
You acknowledge and agree that:
- Telemedicine has limitations compared to in-person care
- A physical examination may be required for diagnosis or treatment
- A consultation may be declined if clinically inappropriate
- Prescribers may refuse treatment where it is unsafe or unsuitable
Prescriptr and its clinicians do not guarantee that a prescription will be issued following consultation.
6. Prescriptions
Where a prescription is issued:
- It is based solely on clinical judgment of the treating clinician
- It may be electronic or digitally transmitted to a pharmacy of your choice (where legally permitted)
- It is subject to national pharmacy and prescribing laws in the destination country
You acknowledge that:
- Pharmacies may refuse to dispense prescriptions issued cross-border
- Certain medications may be restricted or unavailable depending on jurisdiction
- Controlled drugs or high-risk medications may be excluded from remote prescribing
Prescriptions remain valid only as permitted under applicable local law.
7. User Responsibilities
You agree to:
- Provide truthful, accurate, and complete medical information
- Update us regarding changes in your health status
- Use the Service only for yourself (no third-party use)
- Follow medical advice provided
Failure to provide accurate information may result in termination of Service and/or clinical risk.
8. Medical Disclaimer
All content, consultations, and outputs provided via Prescriptr:
- Are not a substitute for emergency care or in-person medical assessment where required
- Are based on information provided by you
- Are subject to clinical limitations inherent in remote medicine
Clinical responsibility lies with the treating healthcare professional, not the platform operator, except where otherwise required by law.
9. Payments and Fees
You agree that payment may be processed either:
- directly by Prescriptr, or
- by third-party healthcare providers or payment partners acting on behalf of Prescriptr, with whom Prescriptr works closely to deliver the Service.
By using the Service, you expressly authorise Prescriptr and/or its authorised third-party partners to collect and process all applicable fees in full on your behalf.
You agree to:
- Pay all applicable fees in full as displayed at the time of purchase; and
- Authorise Prescriptr and/or its designated partners to charge, collect, or process such payments using approved payment methods.
Refunds may be issued at our discretion or where required under applicable consumer protection law.
10. Data Protection and Privacy
We process personal and health data in accordance with the General Data Protection Regulation (GDPR).
We act as either:
- Data Controller for platform operations, and/or
- Data Processor or Joint Controller depending on clinical workflow structure
Your medical data is:
- Stored securely
- Accessed only by authorised personnel
- Retained in accordance with legal and medical record retention requirements

11. Cross-Border Use
If you use the Service outside Ireland:
- You are responsible for ensuring compliance with local laws
- We do not guarantee that all services are available in all jurisdictions
- Some treatments or prescriptions may be restricted depending on destination country regulations
12. Intellectual Property
All content, software, branding, and materials on the platform are owned by or licensed to Prescriptr and may not be copied or reproduced without permission.
14. Limitation of Liability
To the maximum extent permitted by law:
- Prescriptr is not liable for indirect, incidental, or consequential damages
- We are not responsible for clinical decisions made by independent healthcare professionals
- We do not guarantee uninterrupted access to the Service
Nothing in these Terms excludes liability where it cannot be excluded under Irish or EU law.
15. Termination
We reserve the right to:
- Suspend or terminate access to the Service
- Refuse service where misuse, fraud, or clinical inappropriateness is identified
16. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
Where required by law, material changes will be communicated to users.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland.
Any disputes shall be subject to the exclusive jurisdiction of the Irish courts, unless otherwise required by mandatory consumer protection laws in your country of residence within the EEA.
